Introduction
Redundancy Payment Central Fund Limited (ACN 007 133 833) (Incolink) complies with the National Privacy Principles contained in the Privacy Act 1988 (Cth) (Act) to the extent required by the Act.

Collection of personal information
Incolink will not collect personal information unless the information is necessary for one or more of its functions or activities. Further, Incolink will only collect personal information by lawful and fair means and not in an unreasonably intrusive manner. Incolink will collect information directly from the person about whom the information relates when it is reasonable and practicable to do so. Where Incolink collects information from a third party, it will take reasonable steps to ensure that the person about whom that personal information relates is made aware of the fact that it has collected the information.

As Incolink's main function is to operate certain redundancy funds, most of the information collected by it relates to the operation of those funds. Relevantly, Incolink collects personal information from certain entities about their employees to enable it to administer redundancy funds. The type of personal information collected by Incolink from these entities includes:

  • name, street, telephone number(s);
  • date of birth; 
  • email address;
  • occupation; and 
  • salary.

Incolink also collects information provided by users of its website.

Use and disclosure of personal information
Incolink may use or disclose personal information it collects for the primary purpose for which it was collected. If Incolink uses or discloses personal information for a purpose other than the main reason for which it was collected (the secondary purpose), to the extent required by the Act, Incolink will ensure that:

  • the secondary purpose is related to the primary purpose of collection (and directly related in the case of sensitive information), and you would reasonably expect that Incolink would use or disclose the personal information in that way;
  • you have consented to the use or disclosure of the personal information for the secondary purpose;
  • use or disclosure is required or authorised by law; or
  • the use or disclosure is otherwise permitted by the Act. 

Employers of the members of the redundancy funds we administer will give information to us to enable us to maintain funds to protect entitlements to redundancy payments. Employers may also give information to us to enable us to administer any other funds to which employers contribute on behalf of employees.

If you seek any additional services from Incolink, such as counselling or referral services, you may be asked to provide further information for the purpose of fulfilling your request.

In order to administer the redundancy funds and to ensure that the purposes of the funds can be fulfilled, Incolink may disclose personal information. Specifically on request, Incolink will disclose the current registration and contribution status and any other relevant information collected by Incolink through the administration of the funds to:

  • principal contractors on building sites;
  • union representatives (including job stewards);
  • employer association representatives;
  • insurers (and their claims handling agents) when a claim has been made on a relevant policy; and 
  • employer members of Incolink.

Incolink may also disclose to employers, upon request, the amount of the entitlement to redundancy payments of a fund member in order to facilitate the operation of provisions relating to redundancy payments in applicable awards.

We also use personal information we hold to provide details of promotional offers and special events.

Openness
You may request access to personal information we hold about you by writing to Incolink's Privacy Officer at the address below. Where we hold information that you are entitled to access, we will endeavour to provide you with a suitable range of choices as to how you access it (eg. emailing or mailing it to you).

If you believe the personal information we hold about you is incomplete or inaccurate, then you may request amendment to it. We will consider if the information requires amendment. If we do not agree that there are grounds for amendment, then we will add a note to the personal information stating that you disagree with it.
